ELIGIBILITY
CONDITIONS
FOR CONSIGNMENT
- All consigned horses may be subjected to drug testing and all consigners
agree to submit their horse(s) for testing according to the
Equine Canada, Alberta Zone Medications Control Committee,
Chapter XV.
- All consigned horses will have current vaccinations for E and W
encephalitis, Tetanus, Flu and Rhinonumonitis. The consignor
is to have a veterinarian certificate will be on hand
verifying this.
- A Coggins test
is required for all consigned horses.
- All
information and representations are the sole responsibility,
and made on behalf of the consignor.
- The seller
warrants that each horse consigned to the sale is free and
clear of all liens and encumbrances.
- Each consigned
horse must successfully complete an insurance equivalent
physical exam prior to sale date, including musculoskeletal,
eye, respiratory and heart.
- Each consigned
horse is required to successfully undergo pre-sale
inspection by a selection committee. All selected horses will be presented in hand
and will be evaluated for health and basic soundness by sale
veterinarian.
- Show quality
turnout will be strictly enforced.
- The sale
management reserves the right to refuse or withdraw any
horse from the sale without refund or liability to any
party, at it's discretion.

SALE
TERMS
- All bidders
must register at the sales office. The Auctioneer will
accept bids ONLY from registered bidders.
- This is a
reserved auction.
- No Horse
will be sold for under $3,000.00.
- GST will be
charged on horses according to Canadian law.
For out of country buyers GST rebate forms will be
available at the Sales Office.
- Each horse
will be sold to the highest bidder as determined by the
auctioneer, whose decision is final and who, along with the
sale staff, act as agents for the seller but assume no
responsibility for the buyer or the seller.
- The auctioneer
reserves the right to reject any or all bids.
- All horses are
sold as is. IT IS THE BUYER'S RESPONSIBILITY TO ENSURE
THAT THEY HAVE VIEWED ALL INFORMATION(IN THE CASE OF X-RAYS
BUYERS WILL ONLY BE ALLOWED ACCESS WHEN IN THE COMPANY OF A
VETERINARIAN) ON FILE OF SAID HORSE. Right of recourse must be directed to the seller
and not to AIWS or sale management.
- THIS IS A PERFORMANCE
HORSE SALE, BUYERS MUST BE DILIGENT AND CONSULT A
VETERINARIAN IF THEY ARE PURCHASING A HORSE FOR BREEDING
PURPOSES.
- According to
the laws of the province of Alberta, Canada, all horses sold
must be delivered to the new owner with a halter.
- A sale by
auction is complete when the auctioneer announces its
completion by the fall of the hammer or in any other
customary manner, and until that announcement is made any
bidder may retract his/her bid.
- Upon the
auctioneer declaring the horse as sold, all risk, title care
and responsibility shall pass to the buyer.
- Every effort
has been made to ensure the correctness of the catalogue.
However, the sale management and auctioneer assume no
responsibility for errors or omissions.
- Prospective
buyer's will be permitted to ride performance sale horses
for tryout ONLY IF the prospective buyer has proper
riding footwear and approved safety helmet. IN ADDITION,
all prospective buyers must register with the Sales Office
and complete a WAIVER OF LIABILITY. Sale management
and consignors reserve the right to refuse tryouts of any
horse to any prospective buyer.

AIWS, Westerner Park,
management, employees, and Carey Auction Services and
their staff and volunteers accept no responsibility or
liability for injury or damage to person, horses, or
equipment as a result of attending or participating in the
auction.

The right to bid is reserved
expressly by and on the behalf of the seller and the seller
or any one person on his/her behalf may bid at auction.

Every effort has been made to
ensure the correctness of this catalogue. However, the sale
management and auctioneer assume no responsibility for
errors or omissions.
- Terms of sale
are cash, cheque or Credit Card(all credit card purchses are
subject to a 3% office fee) and payment in full must be made to the cashier
immediately after the sale. Valid personal cheques will be
accepted with proper identification (driver's license and
major credit cards) and or standby financial letter of
credit from the buyer's band.
- The sale
management will withhold registration papers until the
buyer's cheque clears the bank. At such time, all documents
will be processed for transfer to the buyer. The seller will
pay all transfer fees, according to Canadian law.
- Phone bids
will be accepted of the following terms are provided:
- A standby financial letter from the bidders
bank.
- Drivers license and major credit card
information.
- Signed bidder's contract.
- To obtain
phone bidder number, contact Jennifer Stephenson at (780) 696 2506 and provide the necessary
documentation. To facilitate the necessary paperwork,
contact must be made prior to June 15th, 2008 Horses
purchased via phone bids will be held at Westerner Park
Stabling of said horse(s) is the responsibility of new
owners at a cost of $50.00 + GST payable to Westerner Park until
June 23rd, 2008 at 10 am. After
this time it is the responsibility of the buyers to arrange
for horse(s) to be moved. Hauling and boarding at the new
facility will be at the buyer's expense. All phone sale
horses will be released to the buyer once payment has been
received in full.
- Stabling of
any horses after June 22nd, 2008 are subject to a fee of
$50.00 + GST payable to Western Park.
- Should the
buyer fail to comply in any respect with all the conditions
above, the sale management may, at its discretion, pursue
any remedy available against the defaulting buyer,
including, but not limited to, taking possession of the
horse(s) and resale of the case, the defaulter shall be
liable for any deficit in the account of the defaulter. In
such a case, the defaulter shall be liable for any deficit
in the account after payment of all costs of maintenance and
resale, attorney fees, cost of litigation, and damages
available to the seller by Canadian law.

BIDDER
REGISTRATION
- To bid at the
auction you must register at the sales office - THERE IS
NO CHARGE
- Bidders will
be required to produce a driver's license or other picture
identification and a major credit cart. A letter of credit
for a major bank will be accepted in addition to, or in
place of, the major credit card.
VETERINARY
CONSULTATION AND PRE-PURCHASE EXAMINATIONS.
- Prospective
buyers are welcome and are encouraged to have a veterinarian
of their choice perform a pre-purchase exam of horses of
interest. THE ONUS IS PLACED FIRMLY WITH THE PROSPECTIVE
BUYER (AND LIABILITY RESTS SOLELY WITH THE BUYER) WITH
RESPECT TO PAYING FOR AND ARRANGING VETERINARY EXAMS.
- Some horses
will have x-rays on file(X-Rays have not been pre-examines
by AIWS) the show office - this will be
stated clearly in the catalogue and on stall charts.
PROSPECTIVE BUYERS MUST ENSURE THAT THEY CHECK WITH THE
CONSIGNOR AND THE SALES OFFICE IN RESPECT TO X-RAYS.
X-RAYS WILL ONLY BE RELEASED IN THE COMPANY OF A CERTIFIED
VETERINARIAN (BUYERS COST).
- Pre-purchase
examinations should be arranged and discussed with the
consignor.
TRY-OUTS
- Prospective
buyers will be permitted to ride sale horses for tryout IF
the prospective buyer has proper riding footwear and
approved safety helmet. In addition, all prospective buyers
must register for a bidder's card at the sales office and
complete a WAIVER OF LIABILITY before the prospective buyer
will be permitted any tryouts. All management and consignors
reserved the right to refuse tryouts of any horse to any
prospective buyer.
- Buyers must
produce their bidders card to each consignor before they
will be allowed to tryout horse(s).
INSURING
YOUR PURCHASE
-
Fall of the Hammer Insurance
is available on all sale horses. Please inquire at the
Sales Office for more details.
- An insurance
agent will from Drayden Insurance will be available during and immediately
following the auction on Tuesday evening to allow purchasers
to insure their new horse. Each horse in the sale will have
an insurance health certificate completed prior to the sale.
This form will be provided to purchasers by the sales office
at the time of payment.
REMOVAL
OF HORSES
- All hoses must
be removed from sale grounds by 10:00 am, Monday June 23rd(Stall charges per night are
$50.00
+ GST payable to Westerner Park, this charge is applicable
to any horses that stay overnight of June 22, 2008). To remove
horses from sale barn, the transport agent must obtain a
release form from the sale office and present it to the barn
manager. The barn manager will be available until 10:00 pm
Sunday June 22nd, 2008, and from 8:00 am to 10:00 am Monday,
June 23rd, 2008.
